Food Avoidance Information Access Agreement
The Food Avoidance Information Database (Database) on the KissYourIBSgoodbye.com website, made available by The Compounding Pharmacist (Pharmacy), is an informational resource for qualified medical providers (Providers) who perform IBS-80 patch testing. The Database is intended to assist Providers in counseling patients about avoidance of food(s) to which they have shown positive IBS-80 patch test reactions. Any Provider wishing to access and use the Database must agree to the following terms and conditions:
1. The Database serves only as an informational tool for Providers who wish to use it to provide food avoidance information to their patients. Use of the Database does not establish a physician-patient relationship between Pharmacy and any patient.
2. Providers shall (i) inform their patients that the information they receive from the Database is only partial; and (ii) advise their patients to research each food themselves to learn as much as possible to maximize adherence to dietary avoidance.
3. Providers may not provide their KissYourIBSgoodbye.com account information, including username and password, to any third party without the express prior written consent of Pharmacy.
4. Pharmacy makes no guarantee that any computer, software, server, device, or other technology associated with the Database is free of viruses or other elements that may contaminate or have other destructive properties.
5. Pharmacy has the right to deny access to the Database to any Provider who has not agreed to abide by the terms of this Access Agreement and reserves the right to terminate access to any such Provider.
6. Pharmacy reserves the right to modify or change the terms of this Access Agreement as it determines from time to time in the best interests of Pharmacy, provided Physicians are notified prior to any such change.
7. Providers must comply at all times with the requirements of the Health Insurance Portability and Accountability Act of 1996 (HIPAA).
8. EACH PROVIDER HAVING ACCESS TO THE FAI PROGRAM SHALL INDEMNIFY AND HOLD PHARMACY HARMLESS FROM AND AGAINST ANY AND ALL LIABILITY, CLAIMS, DAMAGES, LOSSES, COSTS AND EXPENSES (INCLUDING REASONABLE ATTORNEYS FEES) RELATING TO HIS OR HER ACTS OR OMISSIONS OR TO MATERIALS OR INFORMATION HE OR SHE TRANSMITS IN CONNECTION WITH HIS OR HER USE OF THE DATABASE.

Testimonial Terms and Conditions

Proposed Uses: website(s); print advertising and marketing; social media, e.g., Facebook, Twitter, Constant Contact, Instagram, etc.; verbal conversation with clients and prospective clients.

Right to Revoke: You have the right to revoke this Release at any time by providing your revocation and submitting it, in writing, to IBS-80, LLC. Please understand that revocation of this release will not affect any action IBS-80, LLC took in reliance on this release before receiving your revocation.

Release: By agreeing to these terms and conditions, you are authorizing IBS-80, LLC to use your written testimonial and any information contained therein in its public relations efforts. You understand and approve the disclosure of testimonial information to the media and other individuals and entities that may be involved in the public relations efforts. You agree that you will make no monetary or other claims against IBS-80, LLC for the use of your written testimonial.

You hereby authorize IBS-80, LLC to edit your written testimonial to shorten it and correct any grammatical errors. You waive the right of prior approval and hereby release IBS-80, LLC from any and all claims for damages of any kind based on the use of your testimonial or information in your testimonial.

You hereby agree that IBS-80, LLC may use your first name and last initial. You hereby agree that IBS-80, LLC may use your city and state.

You hereby agree and acknowledge that you are of legal age and freely agree to these terms and conditions.
